Information Collection

Elm Design Services, Inc. collects information from our users at several different points on our Web site.

Estimate Request, Sign-up and Contact Information

We request information from the user on our estimate, sign-up and contact form. A user must provide contact information (such as name, email, and mailing address).

Information Use

Personal information is used strictly for our own purposes; contacting clients or for occasional email or postal mailings. This information will never be sold or shared with a third party.

Log Files

Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

Special Offers

Established clients will occasionally receive information on products, services, special deals, and/or a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.

Legal Disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site. We DO NOT Share Personal Information with Third Parties.

Business Transitions

In the event Elm Design Services, Inc. goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred. Users will be notified via email prior to a change of ownership or control of their personal information. If as a result of the business transition, the users’ personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

Choice/Opt-out

Currently we do not share information with third parties. However, if that was to change in the future, our users would be given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to our site. Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by replying to unsubscribe in the subject line in the email or email us at unsubscribe@elmdesignservices.com.

This web site takes every precaution to protect our users’ information. When users submit sensitive information via the web site, their information is protected both online and off-line. Billing

We require a deposit of 50% of the project estimate prior to beginning work, payable by credit card (American Express, Visa, Mastercard) or overnight check. Please note that we cannot begin work until we’ve received your deposit. Minimum deposit is $150 required for jobs totalling less than $300. Balance is due upon final approval of your project, and prior to our releasing the final files to you or the publication.

Project Cancellation

In the unlikely event that Elm Design Services, Inc. cannot create a design that you will approve, the client may cancel the project in writing. A ‘kill fee’ equal to the deposit amount will be charged once your project has been initiated. A lesser fee commensurate with amount of time and materials provided is at the discretion of Elm Design Services, Inc. In the event of a job cancellation, all artwork and/or concepts remain the exclusive intellectual property and copyright of Elm Design Services, Inc. unless released in writing by Elm Design Services, Inc. and the remaining balance of the project’s billable amount is remitted.

Written Estimate

Prior to beginning work, Elm Design Services, Inc. will provide you with a written project estimate. All fees and costs are estimated and valid for 30 days. Changes in the scope of work and/or project specifications may require a revision to the original quote. Any revision in excess of 10% of this quote must be approved in advanced by both parties, and will be reflected in the final invoice.

Turnaround/Rush Charges

Standard turnaround for initial advertising concepts or designs is 5-10 business days from client approval of quote (payment of deposit) unless notified otherwise in advance. Actual turnaround depends on scope of project and current workload. Upon approval, Elm Design Services, Inc. will inform you a specific date to expect your initial concepts. Rush service available as follows: Guaranteed 5 day service - 50%. Guaranteed 3 day service - 70%. Guaranteed 24 hour service - 100% (check availability). Final delivery of files is dependant on client turnarounds and final approvals. We recommend that you provide a minimum of 10 business days prior to your materials deadline in order to avoid rush charges.
